What is a vehicle lien?
In most cases, a vehicle lien represents a legal right a lender has over a vehicle due to a loan. This lien is recorded on the vehicle title. Usually, vehicle liens are not automatically removed from the title even after the lien is paid off. This lien prevents the vehicle title from being transferred or sold to someone else. Here is the process for lien removal, and how we can help you with the process.
Lien Release Process
Every situation is different, but this is our usual method to remove the vehicle lien:
1 DMV Look Up
The DMV records the latest vehicle lien information recorded on the vehicle title. We start the process by looking up the lien holder name and state for the last recorded owner on the title.
2 Form Preperation
The DMV prescribes the form that can be used to request the lien release from the lienholder. With the lienholders information we discovered, we prepare the form and send the lien release authorization letter.
3 Letter Preparation
In addition to the form, we also send a summarized letter to the lienholder with the pertinent facts. This often helps the lienholder understand the situation and facilitate receiving a favorable response.
4 Lien Release Back Up Letter
In our package sent the the lien holder, we also include what is known as a letter of non-interest. This is an alternative letter that the lien holder may also use that will provide the same result of lien removal.
5 Lienholder Mailing
The package is sent to three different lien holder addresses if needed; address listed from the initial search, the current address in case they have moved, the new company in case the lien holder was acquired.
5 Alternative Method
Although this process resolves the issue for most paid off lien removal situations, a response may still not be received from the lienholder. However, using this method will facilitate a court ordered title if needed.
